Michigan Judge Caught with DUI while “Super Drunk”

download (14)Earlier in the week we had a story about the Cake Boss, star of a popular reality show, getting charged with DWI in New York. That case could negatively affect the future of his show. In Michigan, a similar case has happened for someone in a much higher position.

In Ypsilanti, Michigan, a judge has been recommended for a 90 day suspension after he plead guilty to a drunk driving charge. He was towing a boat and trailer at a public ramp while visibly intoxicated. Due to the significant impact on the court system and on the judge’s reputation, the suspension has to be signed off by multiple parties. Now it’s up to the Supreme Court of Michigan to accept or deny the recommendation.

At the time of the arrest, the judge’s BAC was 0.17, labeling him as a “super drunk” under Michigan law. Pennsylvania has similar statues for people with a BAC of over 0.16, or twice the legal limit, and the penalties for being convicted of this level are quite severe.… Read More

Michigan Judge Suspended for Public Drunkenness at Boat Launch

A judge from Ypsilanti, Michigan has been suspended for 90 days by a state disciplinary board for towing a boat and a trailer at a public boat launch while severely intoxicated. District Judge Kirk Tabbey accepted the penalty handed down by the board. The recommendation now goes on to the state’s Supreme Court. Tabbey had been fined on October 16th after pleading guilty to a reduced charge of drunken driving.

According to official reports, police stopped Judge Tabbey on September 17th for suspicion of DUI and found that he had a blood alcohol level of 0.17 percent, which is more than twice the legal safe driving limit of 0.08 percent. Under Michigan law, a BAC level that is twice over the legal limit is considered ‘super drunk’.

DUI Vehicular Homicide Case Begins

download (72)The trial of a North Philadelphia man, Eric Luciano, 34, began recently. Luciano is accused of vehicular homicide that resulted in the death of a Wissi­nom­ing wo­man, Teresa Marquard, 58 on February 24th. According to officials, Luciano lost control of his southbound 1999 Pontiac Montana, when his vehicle veered into oncoming traffic, jumped a curb, onto a sidewalk then struck Marquard who had been walking with her husband before hitting a tree.

According to police reports, the victim, Marquard had seen the vehicle coming. She  screamed and pushed her husband out of the path of the oncoming vehicle. Marquard lost consciousness at the scene of the crash and was taken to an area hospital bleeding from her head and legs. She was later pronounced dead by physicians at around 10:01 a.m.

Lu­ciano had also been crit­ic­ally in­jured in the crash. Lu­ciano is charged for homicide by vehicle while driving under the influence of alcohol, reckless endangerment, involuntary manslaughter and other related charges.… Read More

Wisconsin Man Convicted of 12th DUI

download (6)Sometimes,those who choose to drink and drive don’t see the error of their ways until they have several drunken driving convictions. That seems to be the case for Daniel Frisch, 53, from Manitowoc, Wisconsin. He is now behind bars at the Fox Lake Correctional Institution.

Frisch underwent court mandated alcohol assessments and treatments. Even with all of this, he was not given medication to help him stop drinking or required to have an alcohol interlock on any of his vehicles. Now after his 12th DUI conviction, he was sentenced to 7 years in prison. He is halfway through that sentence and Daniel Frisch is counting the days until he is a free man. He doesn’t really want to stop drinking, but he knows that he has to. He won’t be getting his license back until three years after his release.

If you are an Alcoholic, please Seek Help

download (13)The common conception of DUI drivers is that they are alcoholics. That is absolutely not the case. However, there are some alcoholics who do repeatedly get behind the wheel despite jail time, fines, and license suspensions. USA Today recently profiled one driver from Wisconsin who has just been convicted of his 12th DUI charge.

Despite his repeated arrests, he doesn’t see himself as an alcoholic. Amazingly, despite so many DUI convictions, he has never been involved in a serious crash or killed anyone because of his drinking. He doesn’t see his actions as criminal because of this.

Quoting his statement: Maybe that’s part of my problem; I don’t really look at it as a crime. It’s hard for me to accept punishment for something I grew up thinking was OK. In some ways I guess I still think it’s OK, but I know I have to stop.”

Cake Boss Charged with DUI

According to authorities, celebrity bakery chef, “Cake Boss” Buddy Valastro, 37, of Montville, New Jersey, has been charged with three misdemeanor counts of drunken-driving. Valastro was pulled over by NYPD officers after receiving a complaint that the reality show star had been seen driving his 2014 Corvette erratically in the Hell’s Kitchen neighborhood at approximately 12:30 a.m. Officers state that Valastro smelled of alcohol as well as having bloodshot eyes. Officers administered a Breathalyzer test which he failed. Later tests indicated Valastro had a blood alcohol content of 0.09 percent, which is above the legal limit is 0.08 percent.

Valastro appeared in court, but refused to enter a plea and was released. He is scheduled to appear in court on January 6th, 2015.

Cake Boss Charged with DWI

download (12)The charge of DWI or DUI can do more than just affect your criminal and driving record. It can have serious repercussions on your professional life as well. Celebrities and public servants can have their reputations damaged significantly by just being charged with DUI, let alone convicted. They could even lose their positions.

The head of a reality show on TLC was recently arrested for DWI in New York and may have to face these additional repercussion. The man arrested was Buddy Valastro, the star of TLC’s “Cake Boss”. In addition to the show, he also owns several bakeries in the area.

He was pulled over in the Hell’s Kitchen neighborhood a little after midnight after they saw his car swerving through traffic. Woman Allegedly Sets Car on Fire in DUI Case

It was near midnight on a Saturday night when Doreen Bowman decided to return to the Fraternal Order of Eagles building where she had been earlier that night.  Apparently, she had set fire to her vehicle and when she returned the police stopped her.

She might not have brushed her teeth beforehand, however, because the officer smelled a bit of alcohol on her breath.  When the officer asked for her name, Bowman reputedly gave the officer a fake name.

DUI Accident Involving Officer in Philadelphia

download (71)An accident involving a Philadelphia Police officer and another vehicle being driven by an alleged drunk driver happened on the 16th. Authorities say that the accident took place near the intersection of Front and Indiana Streets in the Fairhill section of Philadelphia. Police officials say that the officer who was involved in the accident was uninjured while the driver of the other vehicle was transported by ambulance to Episcopal Hospital. The condition of the other driver has not been released.

Officials say that the accident is still currently under investigation and no charges have yet been filed.

Watch Yourself When Out on Bail

Getting arrested for any other charge while out on bail is a sure way to get stuck back into jail and getting your bail revoked. The woman in today’s story is experiencing this first hand.

According to the report, she was awaiting trial on a DUI manslaughter case from two years ago. This week she crashed her car in Upper Darby. The report points out that she was high on heroin and prescription drugs at the time of the crash.

She initially told police that she got distracted and crashed, but later confessed to having taken the drugs. She is now in Delaware County Prison in lieu of $250,000 bail.
