Montgomery County DUI ARD requires more than an application: important evaluations, community-service arrangements, and financial obligations may need attention before the admission date. After acceptance, supervision and reporting continue. Planning for both stages can help an eligible applicant avoid preventable problems while preserving time to evaluate the underlying DUI defense.

Two stages to plan for: admission and completion
Accelerated Rehabilitative Disposition is a pretrial diversion program, not a conviction following a guilty plea. Successful participation can lead to dismissal and public-record expungement. Admission nevertheless involves court-approved conditions and important waivers. Our Pennsylvania DUI ARD guide explains the statewide framework.
Montgomery County’s procedures make the distinction between getting admitted and finishing especially important. A person may be pursuing evaluations and community service before placement, then managing reporting, treatment, and any remaining obligations afterward. Do not assume that every requirement starts on the day a judge admits you.
A useful case plan identifies each task, the office responsible, the deadline, and the proof needed. A missed appointment or an incomplete document should be addressed promptly rather than left until the next court listing.
Who decides whether you qualify?
The Montgomery County District Attorney’s ARD program generally addresses first offenders and requires individualized screening. The prosecutor’s recommendation and court approval are separate from simply submitting a form. Prior convictions, an earlier diversion program, the current charges, and information from police or affected people can matter.
State law also restricts DUI-ARD involving specified prior DUI dispositions, a crash causing another person’s death or serious bodily injury, or a passenger under 14. The exact prior-offense provision includes a narrow exception; eligibility should be evaluated from actual records rather than memory. See Section 3807.
Being eligible does not answer whether accepting ARD is the best resolution. Counsel should first examine the stop, testing, video, and other evidence. The firm’s Montgomery County DUI defense services include reviewing the charge as well as possible diversion.
Applying after the preliminary proceedings
The DA’s published process calls for a written application promptly after the preliminary-hearing stage and describes waivers associated with preliminary hearing and arraignment. Discuss the consequences of a waiver with counsel before signing. The application should accurately identify prior matters, even when you believe they were dismissed or cleared.
Bring the criminal complaint, court notices, criminal-history dispositions you have, driver’s-license information, and any PennDOT letters to the consultation. In a collision case, insurance and restitution records can be important. Do not miss a listed appearance based solely on an expectation that ARD paperwork will resolve it.
An application acknowledgment is not the same as a final court disposition. Keep track of whether the case is awaiting screening, accepted subject to prerequisites, or formally admitted.
CRN, assessment, treatment, and safety school are different tasks
The county’s DUI-ARD requirements direct applicants to arrange a CRN evaluation through the DUI Unit promptly. That evaluation can lead to a separate drug-and-alcohol assessment. The current county instructions identify Rise Above for that assessment and describe DUI Unit scheduling of Alcohol Highway Safety School after CRN.
The distinctions matter in practice:
| Requirement | What to clarify before attending |
|---|---|
| CRN evaluation | The correct scheduling channel and whether results have reached the DUI Unit. |
| Full assessment | Whether one is required and which provider will be accepted. |
| Treatment | The recommended level of care and documentation of enrollment and completion. |
| Highway Safety School | The assigned course and how successful completion is recorded. |
A full assessment can also be required under state law based on BAC or screening results. Finishing CRN alone does not necessarily satisfy every clinical requirement. For treatment, obtain confirmation that the provider and course of care satisfy the order; do not assume an unrelated counseling certificate will be enough.
Community service and hardship requests before admission
Montgomery County’s published instructions require community service before the ARD date and prior approval for alternate arrangements. They also require payment of court costs before admission unless hardship relief is granted. A request concerning inability to pay is to be submitted at least one week before the ARD deadline. Consult the current county instructions and your case-specific notice together.
The practical response to a work, health, transportation, or financial obstacle is to raise it early and document it. Completing hours at an unapproved organization or waiting until court to explain a payment problem can create an avoidable dispute over compliance.
Ask counsel to distinguish costs due for admission from restitution or other amounts governed by separate terms. An acceptance letter’s estimate should not be treated as a permanent final account balance.
Reporting after the court accepts you
The county identifies Monitor Connect as its reporting system for ARD supervision and supplies registration instructions after placement. Follow the assigned reporting schedule, preserve confirmation of submissions, and promptly correct contact information. An online reporting system does not remove the obligation to comply with other court conditions.
A practical supervision file should contain the admission order, reporting instructions, class and treatment records, community-service verification, receipts, and correspondence about approved accommodations. That file can help resolve a disagreement about whether something was completed or submitted.
Pennsylvania’s DUI-specific supervision range is six to twelve months. The actual order controls within that framework. A general statement about a two-year ARD term for other criminal cases should not be substituted for the DUI rules.
Will ARD suspend your driver’s license?
The answer depends on the DUI category and circumstances, not simply the county. The usual adult BAC bands are no ARD suspension below .10%, thirty days from .10% to below .16%, and sixty days at .16% or above. Unknown BAC, drug charges, qualifying accident circumstances, and being under 21 change the analysis. See the complete statewide ARD suspension table.
A blood- or breath-test refusal can produce a separate civil suspension. Bring the notice to counsel immediately rather than waiting for ARD admission. The criminal disposition and the licensing case may have different deadlines and different available arguments.
Follow PennDOT’s suspension and restoration instructions. Do not calculate an assumed return-to-driving date without confirming that the required credit and restoration steps have occurred.
Completion, expungement, and the limits of record clearing
Successful completion can support dismissal and expungement of the public arrest record under Rule 320. Verify that the court has entered the necessary order and that outstanding compliance issues have been resolved. Finishing a last class is not itself an expungement order.
Current DUI law also preserves limited nonpublic ARD completion records and addresses later DUI conduct following diversion. It would be inaccurate to promise that ARD leaves no governmental trace. Questions about employment applications or licensing disclosures require attention to the exact question being asked.
Montgomery County DUI ARD questions
Can I do community service near my home instead?
Ask for approval before making alternate arrangements. Montgomery County’s instructions specifically require advance authorization for alternatives; choosing your own placement does not guarantee the hours will count.
What happens if I cannot afford all the costs before admission?
Raise the issue before the deadline and ask counsel about a documented hardship request. The county publishes a request process; relief should not be assumed until it is granted.
Does approval for ARD mean I can stop defending the case?
Not before you understand the offer and its waivers. There may be factual or legal reasons to contest the DUI, and admission is not complete merely because an application has been submitted.
