Northampton County DUI ARD Program

Northampton County DUI ARD involves an application, screening, required evaluations, and court approval. The county’s published materials describe more than one application deadline, so an applicant should prepare promptly and confirm the current instructions rather than assume the later date is safe. The goal is to preserve a possible diversion option without overlooking the underlying DUI defense.

What DUI ARD offers

Accelerated Rehabilitative Disposition is a pretrial program through which an eligible defendant may earn dismissal of the pending charges. It is not a guilty plea or a DUI conviction. Successful completion can also support expungement of the public arrest record.

The benefit comes with obligations. Education, screening, assessment or treatment when required, supervision, payments, and a possible license suspension must be evaluated before accepting the agreement. An ARD offer is not a promise of no consequences.

Our Pennsylvania DUI ARD overview covers the statewide framework. This page focuses on Northampton County’s application and supervision process and the questions to resolve before placement.

Clarify the application deadline early

The Northampton County Court’s DUI-ARD program page says applications must be received before formal arraignment. Its separate DUI-ARD FAQ refers to submission within ten days of the preliminary hearing. Those instructions should not be treated as an invitation to wait until the later date.

Prepare the application promptly after the preliminary-hearing stage and have counsel confirm the operative deadline from the current packet, court notice, and appropriate county office. When feasible, completing submission within the earlier stated period avoids relying on an unresolved discrepancy.

The public materials describe a notarized application. Confirm that all required signatures, supporting records, and notarization are complete before submission. Retain a copy and evidence of delivery. A form that was drafted but never received does not preserve the same position as a timely completed filing.

Eligibility and screening are individualized

The program’s screening process is separate from simply returning an application. The prosecutor reviews eligibility, and the court decides admission on the required recommendation. A first DUI charge does not make acceptance automatic.

Section 3807 prohibits submission in specified circumstances involving prior DUI dispositions within ten years, a crash causing another person’s death or serious bodily injury, or a passenger under 14. The exact prior-offense provision includes an exception that should be evaluated from the actual charge and history.

Provide counsel with accurate information about past cases, including diversion outside Pennsylvania. Do not assume that an old dismissal or expungement makes the prior matter irrelevant to an application question. Additional charges, crash facts, and driving history may also require an explanation or supporting documentation.

Know which court event you are attending

Northampton’s program materials distinguish preliminary proceedings, formal arraignment, screening, and the ARD hearing. These serve different purposes. An appointment with a program office is not necessarily the court event at which ARD is accepted.

Keep the actual notice for each appearance and confirm its location, date, and purpose. Do not assume that every appointment takes place at the same office or that an application excuses attendance. Obtain clear instructions before making work or travel arrangements.

Before signing hearing or constitutional waivers, discuss what is being given up and why the proposed resolution is appropriate. The firm’s Northampton County DUI defense practice can examine the stop, testing, and other evidence alongside the diversion decision.

CRN and full assessments should not be confused

A CRN evaluation is required for DUI ARD. It screens alcohol or drug involvement and may lead to further assessment. Alcohol Highway Safety School is also a separate requirement under state law.

Some local public instructions use broad language suggesting that a separate drug-and-alcohol evaluation is unnecessary for ARD. That should not be read as overriding Pennsylvania’s DUI-ARD assessment requirements. A full assessment is required when the statutory criteria apply, including a BAC of .16% or above or screening that indicates likely substance-use disorder.

Ask which evaluation has been ordered and which provider is authorized to complete it. If treatment is recommended, confirm the level of care, completion expectations, and proof required. A CRN report, education certificate, and treatment discharge record answer different questions.

How long does Northampton County DUI ARD last?

The county FAQ describes a six-month ARD probation period. State law permits DUI supervision for six to twelve months, and the order entered in the particular case controls. Do not translate an online program description into a guarantee before your conditions have been approved.

The total time from arrest to final record relief may exceed the supervision term. Screening, evaluation scheduling, court listings, and processing the final disposition take time outside that term.

Build a completion plan from the actual admission date and order. Include education, treatment when required, reporting, payments, and any community-service conditions. If a requirement becomes difficult to complete, seek a permitted adjustment rather than simply letting the deadline pass.

Understanding fees and payment obligations

An online starting estimate is not a final price for every applicant. The total may include court costs, supervision, evaluations, education, treatment, restitution, and license-related expenses. Attorney fees are separate.

Ask for current payment instructions and identify what is due before admission versus during supervision. Keep receipts with the docket number and confirm that balances have been credited. A payment sent to the wrong office may not resolve the obligation shown on the case.

Discuss a genuine financial hardship before it becomes noncompliance. The availability and terms of relief depend on the case and the relevant decision-maker; they should not be assumed from another county’s policy.

Will you lose your license through ARD?

Northampton County does not replace Pennsylvania’s statutory DUI-ARD suspension categories. BAC below .10% generally carries no ARD suspension when no overriding circumstance applies; higher BAC categories, drug DUI, unknown BAC, qualifying crashes, and age under 21 can require suspension. Our ARD license-suspension table sets out the distinctions.

A separate chemical-test refusal can create additional civil license consequences. Bring every notice to counsel promptly. An application for ARD is not an appeal from a PennDOT suspension.

Follow PennDOT’s current suspension and restoration instructions, not an assumed date based on the end of probation. Confirm restoration before driving again.

Dismissal, expungement, and later DUI consequences

Successful completion can lead to dismissal and public-record expungement under Rule 320. Verify that the court has entered the appropriate order and that compliance issues are resolved. Completion and removal of public records are related steps, not necessarily simultaneous events.

Current law also retains a limited nonpublic record of DUI-ARD completion for specified future prosecution purposes. The DUI-following-diversion provision can matter if a later DUI occurs within its statutory period. Public expungement therefore should not be described as a guarantee that ARD can never be considered again.

Northampton County ARD questions

Which deadline should I use when the county pages differ?

Do not assume the later deadline controls. Prepare promptly, bring the conflicting instructions to counsel, and confirm the operative requirement with the current application materials and court notice.

Is notarizing the application enough to secure admission?

No. A properly completed application is a submission for review. Screening, required prerequisites, the prosecutor’s recommendation, and court approval still matter.

Do I need treatment in every ARD case?

Not every case results in a treatment requirement, but evaluation and assessment rules still apply. Follow the lawful assessment recommendation and the conditions actually ordered.
