A Look at the DUI Trial Process in Pennsylvania

When you are charged with a DUI in Philadelphia and decide to
take your case to trial, there are several things that you can reasonably expect to occur. While no two trials are exactly alike, they do tend to follow the same pattern of events. If you have decided to take your case to a judge or jury, here is what may happen.

1. Expert Witnesses

Your attorney or the prosecutor may call expert witnesses. The prosecution will typically call a law enforcement officer to the stand. These men and women are trained on enforcing DUI laws and will introduce testimony meant to have you convicted. Your attorney may call expert witnesses to point out the flaws in the prosecution’s case.

It’s important to understand that expert witnesses do not come free, and you will pay for their assistance. It is safe to figure that you will pay at least $1,000 for each expert who testifies on your behalf.

2. Motions to Suppress Evidence

Filing a motion to suppress evidence is not only seen on television crime dramas. This happens in real life, especially when your attorney feels that the police arrested you without cause or obtained evidence illegally. A motion to suppress evidence is heard before the trial begins and only by a judge. One of the most typical reasons a defense attorney files a motion to suppress is because they believe the office had no probable cause to stop you in the first place.

3. Your Own Testimony

Your attorney will help you determine if it is in your best interest to give testimony or to stay quiet. It is well within your rights to do either. You may initially insist on being able to testify on your own behalf, but if your attorney advises against it, it is suggested that you heed that advice. Remember that your attorney is working in your best interest.

If you have been arrested for DUI and choose to take your case to trial, you can reasonably expect the three things above to occur. It is true that every trial is different, but most follow the same general format.
